By accessing or using any part of the web site, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by Hilzinger Healing, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 13 years old.

Your hilzingerhealing.com Account and Profile

If you create an account and profile on the Website, you are responsible for maintaining the security of your account and profile, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the profile. By submitting Content to Hilzinger Healing for inclusion on your Website, you grant Hilzinger Healing a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your blog. If you delete Content, Hilzinger Healing will use reasonable efforts to remove it from the Website, but you acknowledge that caching or references to the Content may not be made immediately unavailable.

Payment and Renewal

General Terms

By selecting a product or service, you agree to pay Hilzinger Healing the one-time and/or monthly or annual subscription fees indicated (additional payment terms may be included in other communications). Subscription payments will be charged on a pre-pay basis on the day you sign up for an Upgrade and will cover the use of that service for a monthly or annual subscription period as indicated. Payments are not refundable.

Automatic Renewal

Unless you notify Hilzinger Healing before the end of the applicable subscription period that you want to cancel a subscription, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee for such subscription (as well as any taxes) using any credit card or other payment mechanism we have on record for you. Upgrades can be canceled at any time by submitting your request to Hilzinger Healing in writing.

Services

Fees; Payment

By signing up for a Services account you agree to pay Hilzinger Healing the applicable setup fees and recurring fees. Applicable fees will be invoiced starting from the day your services are established and in advance of using such services. Hilzinger Healing reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you. Services can be canceled by you at anytime on thirty (30) days written notice to Hilzinger Healing.

Support

If your service includes access to priority email support. “Email support” means the ability to make requests for technical support assistance by email at any time (with reasonable efforts by Hilzinger Healing to respond within three business days) concerning the use of the VIP Services. “Priority” means that support takes priority over support for users of the standard or free hilzingerhealing.com services. All support will be provided in accordance with Hilzinger Healing standard services practices, procedures and policies.

Responsibility of Website Visitors

Hilzinger Healing has not reviewed, and cannot review, all of the material, including computer software, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, Hilzinger Healing does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Hilzinger Healing, hilzingerhealing.com, the hilzingerhealing.com logo, and all other trademarks, service marks, graphics and logos used in connection with hilzingerhealing.com, or the Website are trademarks or registered trademarks of Hilzinger Healing or Hilzinger Healing’s licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any Hilzinger Healing or third-party trademarks.

Advertisements

Hilzinger Healing reserves the right to display advertisements on your blog unless you have purchased an ad-free account.

Attribution

Hilzinger Healing reserves the right to display attribution links such as ‘Blog at hilzingerhealing.com,’ theme author, and font attribution in your blog footer or toolbar.

Changes

Hilzinger Healing reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. Hilzinger Healing may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.

Termination

Hilzinger Healing may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your hilzingerhealing.com account (if you have one), you may simply discontinue using the Website. Notwithstanding the foregoing, if you have a paid services account, such account can only be terminated by Hilzinger Healing if you materially breach this Agreement and fail to cure such breach within thirty (30) days from Hilzinger Healing’s notice to you thereof; provided that, Hilzinger Healing can terminate the Website immediately as part of a general shut down of our service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer of Warranties

The Website is provided “as is”. Hilzinger Healing and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Hilzinger Healing nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.

Limitation of Liability

In no event will Hilzinger Healing, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Hilzinger Healing under this agreement during the twelve (12) month period prior to the cause of action. Hilzinger Healing shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

General Representation and Warranty

You represent and warrant that (i) your use of the Website will be in strict accordance with the Hilzinger Healing Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.

Indemnification

You agree to indemnify and hold harmless Hilzinger Healing, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.

Miscellaneous

This Agreement constitutes the entire agreement between Hilzinger Healing and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Hilzinger Healing, or by the posting by Hilzinger Healing of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by the laws of the state of Illinois, U.S.A., excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts located in DuPage County, Illinois. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally settled in accordance with the Comprehensive Arbitration Rules of the Judicial Arbitration and Mediation Service, Inc. (“JAMS”) by three arbitrators appointed in accordance with such Rules. The arbitration shall take place in Chicago, Illinois, in the English language and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys’ fees. If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; Hilzinger Healing may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.

4. Gathering of Non-Personally-Identifying Information

Depending on cookie settings as explained above, Hilzinger Healing may collect non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. 5.1 Information Collected through Google Analytics

We measure visitors to our website using Google Analytics. Depending on cookie settings as explained above, this records what pages you view within our site, how you arrived at our site and some basic information about your computer. The information we collect from analytics helps us understand what parts of our sites are doing well, and which need changing. 5.2 Information Collected through Newsletter and Mailing Lists

As part of the registration process for our monthly e-newsletter, we collect personal information including your first name, last name and email address. We use this information for several reasons: to tell you about posts, events and offers; to contact you if we need to obtain or provide additional information; to check our records are correct; and to check every now and then that you are satisfied with our site and services. We do not rent or trade email lists with other organisations and businesses.

We use a third-party provider, MailChimp, to deliver our newsletter. 5.3 Information Collected through the Facebook Comments Plugin

We allow visitors and registered users to comment on our content using the Facebook Comments Plugin. This plugin requires users to login using a Facebook Account, and is subject to Facebook’s own Data Policy.

5.4 Information Collected through our E-Commerce Facility

While you visit our site, we’ll track:

Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping.

Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order.

We’ll also use cookies to keep track of cart contents while you’re browsing our site.

When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

5.6 Information Collected through Google/Gmail Account Login

We collect your email address and other Google/Gmail Account profile information when you connect your Google/Gmail Account to Hilzinger Healing to facilitate logging in to our site. Please note, when you log in to Hilzinger Healing using your Google/Gmail Account, you will also be logged in to your Google/Gmail Account within the browser you are using.

5.6 Information Collected through our Security Partners

5.6.1 Security-Related Logs – iThemes (iThemes Media, LLC)

The IP address of visitors, user ID of logged in users, and username of login attempts are conditionally logged to check for malicious activity and to protect the site from specific kinds of attacks. Examples of conditions when logging occurs include login attempts, log out requests, requests for suspicious URLs, changes to site content, and password updates. This information is retained for 60 days.

5.6.2 Security-Related Data Sharing – iThemes (iThemes Media, LLC)

This site is scanned for potential malware and vulnerabilities by Sucuri’s SiteCheck. We do not send personal information to Sucuri; however, Sucuri could find personal information posted publicly (such as in comments) during their scan. For more details, please see Sucuri’s privacy policy.

This site is part of a network of sites that protect against distributed brute force attacks. To enable this protection, the IP address of visitors attempting to log into the site is shared with a service provided by ithemes.com. For privacy policy details, please see the iThemes Privacy Policy.

5.6.3 Security-Related Data Retention – iThemes (iThemes Media, LLC)

Security logs are retained for 60 days.

5.6.4 Security-Related Data Processing – Wordfence (Defiant, Inc.)

The processor will process Customer Personal Data submitted, stored, sent or received by Customer, its Affiliates or End Users via the Services for the purposes of providing the Services and related technical support to Customer in accordance with the Data Processing Agreement.

Defiant may collect name, email address, address, telephone number and payment information.

When a Customer uses specific features of the Services, Defiant may collect the following types of
EU Personal Data:

When using the Services Defiant may collect the following Customer Data: originating Internet
Protocol (IP) address, proxy IP address, url accessed, complete http header, http request body, and
cookies (e.g., Google Analytics, Root Commerce (shopping cart contents), WordPress authentication
cookie).

When using the site cleaning service, Defiant may download a complete copy of the Customer’s
website including the website database which may include Customer Data.

Defiant automatically collects Customer and End User search queries and the date and time of the
Customer and/or End User’s request and referral URL. Depending on the settings of a Customer
and/or End User’s computer or mobile device (“Device”), Defiant also automatically collects: IP
address; MAC address; Device make, model and operating system version; mobile network
information; internet service provider; browser type and language; country and time zone in which
the Device is located; and metadata stored on the Device. When permitted, Defiant also may collect
data about a User’s geographic location through GPS, beacons and similar technology.

All EU Personal Data is collected to operate, manage and improve the Services and ensure the
technical functionality and security of the Services.

EU Personal Data submitted, stored, sent or received via the Services may concern the following categories of data subjects: End Users including Customer’s employees and contractors; the personnel of Customer’s customers, suppliers and subcontractors; and any other person who transmits data via the Services, including individuals collaborating and communicating with End Users.

5.6.5 Security-Related Data Retention – Wordfence (Defiant, Inc.)

The applicable Term plus the period from expiry of such Term until deletion of all Customer Data by Processor
in accordance with the Data Processing Agreement.

6. Information Collected from Registered Users

We ask visitors who register at hilzingerhealing.com to provide a first name, last name, username and email address. Please note, as a condition of registration, the user’s first name and last name, and any information the user chooses to add to their user profile, including country, signature, healing interests and social media links, will be made publicly visible and searchable. Registered user information is retained in our website’s database indefinitely, but can be corrected, deleted or exported upon request – see Your Rights below.

We have strict security measures in place to try to protect your information and make sure that it is not lost, damaged or accessed by anyone who should not see it. In the unlikely event of an unauthorized disclosure of your data we will notify you by email, and act in accordance with our legal requirements to resolve such disclosure and prevent any future unauthorized disclosure. Every user affected by the unauthorized disclosure will be notified by us.

12. The Rights of Children

Hilzinger Healing takes the privacy of children extremely seriously. We do not intentionally target our services to children, and we do not offer services such as training sessions to minors without parental consent.

13. Your Rights

You can ask us for a copy of your personal information, which we will send to you as soon as possible (but within 30 days). We may require you to provide verification of your identity before providing a copy of the information we hold.
